DUI

DUI charges can affect your record, license, and future opportunities, making clear legal guidance important.

Lawyers shaking hands

A DUI charge can be stressful and disruptive, especially if this is your first experience with the criminal justice system. Even a single accusation can affect your driver's license, your criminal record, your employment, your insurance costs, and future opportunities.

Because Pennsylvania DUI law is highly technical and the consequences can be significant, it is important to understand your rights and options as early as possible. DUI cases are rarely as simple as they first appear. What may seem like a straightforward arrest often depends on a series of legal and factual issues that must be examined carefully, from why the stop occurred to how the investigation was conducted and whether testing procedures were performed properly.

We work closely with clients to help them understand the charges they face, the evidence involved, and the legal options available to them. Our goal is to provide clear, practical guidance at every stage while carefully evaluating the strength of the prosecution's case.

Building a Defense

DUI defense requires examining each stage of the encounter between the driver and law enforcement, beginning with the initial stop and continuing through the investigation, arrest, testing, and filing of charges.

The prosecution carries the burden of proving that the officer had a lawful reason to stop the vehicle, that there was sufficient evidence to justify the arrest, and that any testing was performed in accordance with legal and scientific standards. If the evidence is inconsistent, incomplete, or obtained in violation of legal requirements, those issues may have a meaningful impact on how the matter is resolved.

Traffic Stops and Investigations

One of the first questions in any DUI case is whether the officer had a lawful reason to stop the vehicle. Law enforcement must generally have reasonable suspicion that a traffic violation or other issue has occurred before initiating a stop. If that justification is unclear or unsupported, it may raise important legal questions.

The investigation that follows also deserves close examination. Officers rely on observations about driving behavior, physical appearance, and speech patterns when assessing impairment. Video footage, dash camera recordings, and body camera recordings may help clarify what actually occurred during the interaction.

Field Sobriety Testing

Field sobriety tests are designed to evaluate coordination, balance, and the ability to follow instructions. However, these tests are not always administered under ideal conditions. Roadside environments may include uneven surfaces, poor lighting, heavy traffic, or weather conditions that affect performance. Medical conditions, physical limitations, and other individual factors can also influence results.

Because of these variables, field sobriety test results should be evaluated carefully rather than assumed to be definitive indicators of impairment.

Chemical Testing and Evidence

Many DUI cases involve breath or blood testing used to estimate blood alcohol concentration. These forms of testing are often treated as key evidence, but they must follow specific protocols to produce reliable results. Questions may arise regarding how the sample was collected, how it was stored, whether equipment was properly calibrated, and whether all legal requirements were satisfied. Timing between the driving event and the test can also influence how results are interpreted.

Beyond testing results, police reports, body camera recordings, equipment maintenance records, laboratory documentation, and witness statements can all play a role in understanding how the evidence was obtained. A careful review of these materials can sometimes reveal gaps, inconsistencies, or procedural errors.

Moving Forward

DUI charges can carry serious consequences, including license suspension, fines, required programs, and in some cases possible jail time. The impact of a conviction can extend well beyond the courtroom.

Facing a charge does not mean the outcome is predetermined. Every case presents its own facts and legal questions that deserve careful analysis. We work with clients to provide clear explanations of the process, thoughtful evaluation of the evidence, and practical guidance on their options while pursuing the best possible outcome under the circumstances.
